ASSOCIATION—CONSTITUTION  & BY-LAWS

DEFINITIONS

(A)   The University of Iowa American Rehabilitation Counseling Association (UIARCA) shall mean the association of students in the Rehabilitation Counseling Program at the University of Iowa.

(B)       "Member" shall mean a person who is current a student in the rehabilitation counseling program at the University of Iowa, either at the Master’s level or the Doctoral level of study.

(C}      "Chair" shall mean those elected officials who comprise the executive board of UIRCA and is a second year student.

(D)       "Advisor shall mean the faculty representative who is responsible for advising UIRCA.

(E)        “Student” shall mean anyone who has been accepted in the program for Rehabilitation Counselor Education either at the Master’s or Doctoral level.

(F)     "Co-chair" shall mean those elected officials who compromise the executive board of UIRCA and are elected as a first year student.

(G)     “Representative”  shall mean person who holds an office of either President, Vice-President, Treasurer, Secretary, or Chairperson.

ARTICLE I:  NAME AND PURPOSE

Section 1.

The name of this organization shall be The University of Iowa American Rehabilitation Counseling Association (UIARCA).    

This association will be affiliated with the American Rehabilitation Counseling Association (ARCA) as a student chapter.  This affiliation requires that UIRCA follow and adhere to all ARCA by-laws and ethical codes.

 

 

Section 2.

The purpose of UIARCA is to be an organized support group for all students in the Rehabilitation Counseling Program. The organization will provide a student liaison among faculty and students, and will provide the opportunity for networking among students and rehabilitation professionals. UIARCA shall remain a very close and active affiliation with ARCA. UIARCA will be an advocacy group in the support of disabilities rights in the University of Iowa Community and community at large.

UIRCA will also uphold the goal of professional development and the process of building a professional identity for upcoming students and counselors through its support and promotion of affiliation with professional organizations.  UIARCA encourages the membership of ARCA and the ACA (American Counseling Association) as a means of strengthening the political and social voice of the profession of Rehabilitation counseling and its overall influence in research.  UIARCA will seek to promote attendance and participation in conferences as a means of sharing of knowledge in the field.

UIARCA’s commitment to issues of rehabilitation within the University community and the community at large is a fundamental priority within all aspects of UIARCA. Meetings, e-mail and other social activities shall strive to provide avenues through which the academic, personal, social and professional needs of its members may be met. The grassroots structure of UIARCA encourages and depends upon the participation of its members at every level in order to realize the overall goal: the development of highly competent, ethical and creative rehabilitation professionals.

ARTICLE II.  MEMBERSHIP

Section 1.

UIARCA will in no aspect of its programs shall there be any difference in the treatment of persons because of race, national origin, color, creed, religion, sex, age disability, veteran status, sexual orientation, gender identity, or associational preference, or any other classification that would deprive the person of consideration as an individual.  The organization will guarantee that equal opportunity and equal access to membership, programming, facilities, and benefits shall be open to all persons.

Section 2.

1.         Membership in UIARCA should be open to Rehabilitation Counseling students at the University of Iowa. It is highly encouraged that members also be currently affiliated with ARCA and the ACA.

2.         The Advisor volunteers his/her time to assisting UIARCA officers in coordinating and planning activities as needed. The advisor as the option of attending meetings and will be provided a report at the end of each semester, which will describe the activities members are involved in.  The advisor is also available should any inter personal of coordination difficulties be encountered.

 3.        Membership privileges are as follows:

A. Voting rights in all elections and proposals.

B. Formal representation to the faculty and academic programs.

4.         Membership in UIARCA shall terminate in respect of a person who ceases to be a student of in the program for Rehabilitation Counselor Education at the University of Iowa prior to graduation.

 

ARTICLE III: OFFICERS

Section 1 – The Executive Office

Anyone who wants to serve on the executive committee must be a current ARCA member.

The Executive office shall comprise of the following positions: President, Vice-President, Treasurer, Secretary, and Chairpersons. The President and Vice-President will be formally elected positions held by PhD level students. The positions of Treasurer, Secretary, and chairpersons shall be voluntary self-nomination, with the approval of the majority of members at the first meeting of the academic year.  Should there be more than one volunteer for any one of these positions an election may be held. There will be one Master’s level chairperson, and one PhD chairperson

The term of office begins the fall semester and continues for that full academic year.

Section 2 - Officer Elections and Nominations

Election for the position of President and Vice-President will be held in the last month of the spring semester prior to the year that person will serve.  These representatives and the Academic advisor will select a date for the first general meeting at which selection of the other executive positions will take place.

Positions will be filled every fall term within the first month of classes. New representatives will take office immediately upon election. Verbal nominations will be made during the UIARCA general meeting.  Self- nominations are acceptable.  However, a 2/3 members vote is necessary for approval.  If this is not possible because of inadequate attendance, an electronic vote may be held following the meeting, in which case a 2/3 response is necessary for a final decision.

Section 3 - Duties of Representatives

The President shall preside over all UIARCA member meetings and board meetings following the agenda presented in the bylaws. The Vice-President shall be a representative in training under the President, and should work side by side with the other representatives in carrying out responsibilities.

The Secretary will also share in the responsibilities, and will also be expected to keep record of the minutes of meetings held. The Treasurer shall be asked to go to annual budgeting workshops a required by the University of Iowa’s Office of Student life to maintain recognition on the University campus.  If either the Secretary or Treasurer are unable to accomplish these tasks for any reason-including vacancy of position- the chairpersons will be required to fulfill these duties as necessary.

Joint Responsibilities of the Executive Board

Although each position has its specific duties and responsibilities, jointly the executive board will:

1. Act as liaisons between students and faculty on matters concerning curriculum and student affairs/relations.

2. Have Administrative input into agendas for general and executive UIARCA meetings.

3. Ensure the appointment/election of vacant positions.

Section 4 – Specifics of Positions

Vacancies-Executive positions shall be ipso facto vacated if:

1. The person ceases to be a student of the Rehabilitation Counseling program at the University of Iowa.

2. If by notice in writing to the UIARCA Executive Board of individual resignation.

Good Standing Removal - Any representative may at any time be removed from office and another appointed by the affirmative vote of two-thirds of UIARCA members at the general meeting duly called for that purpose.  Calling of such a meeting requires that 2/3 of the members have signed a petition requesting a meeting for removal of the representative, with the consent of the Faculty advisor, and the attendance of all executive board members.

A person is considered to not be in good standing if he/she fails to carry out the duties of office and/or fails to actively participate in the association.

Second year students and other senior part-time students may run for office and take part in the election of a second year officer in the event a vacancy occurs.

First year students and first year part-time students may run and take part in the election of a chair position in the event a vacancy occurs.

Internship Period – A representative shall resign their position in the second year when they have confirmation that due to long distances of their internship site, they will be unable to fulfill the responsibilities. Should the representative have confirmation of this predicament prior to election at the fall of each year, the individual is obliged to announce his/her resignation. At that time the election of a new representative to fill the vacancy will occur at the fall election meeting.

Election and Removal - Upon the completion of two consecutive academic years on the executive board, representatives should retire.

Accountability – Representatives shall be fully accountable for their designated areas. However, they may oversee their responsibilities directly or indirectly by appointing and monitoring a committee.

Representative  Signature - On such occasion that the signature is required on any form or document, the officer who signs shall recognize that it is solely for administrative purposes and not in terms of ultimate authority over UIARCA

 

 

ARTICLE IV: OPERATING PROCEDURES

Section 1 – Executive Board Meetings

Place of Meeting- The executive board meeting may be held at any place at any time without formal notice if all representatives and the advisor are in consent. Should full consent not be given, a notice of three (3) days will be issued to representatives who must make every effort to attend such meetings.

Voting- Any major decision at the executive level must have all officers in attendance. Voting for elections and on other issues requires a 2/3 members vote at a meeting.  If this is not possible because of inadequate attendance, an electronic vote may take place following adjournment of the meeting.  In this case, a 2/3 response is still necessary for final decision.

 

 

 

Special Circumstance-  Voting on the stand of UIARCA on issues that come up outside of meetings that need attention prior to the next meeting held by the organization may be held electronically.  In such a case, a document on the proposed stance of the organization will be sent out to all members.  A response will be requested within a specific time frame from each member.  Responses received by that time will be counted-approvals and rejections-- a decision on the proposal will be made based on responses received.  This may only occur on such occasions where it is impossible to hold a meeting prior to the deadline for that decision.

Finances  --Upon dissolution state money and mandatory student fees revert back to the granting organization.

Group fees should be divided as stated in the constitution and carried out by the dissolving group’s members and officers.

If group has dissolved and group fees have not been divided as stated in constitution by 5 years from last account activity, monies in group 00 account will revert to an account specified for this purpose within UISG.  These funds will then be available for distribution through SABAC guidelines in compliance with University of Iowa policy.

Authority- Decisions regarding major policy changes, project support and objectives, and other decisions of major consequence to UIARCA shall be decided by the general membership. Financial decisions over twenty dollars ($20.00) must be approved by the faculty advisor and all executive members.  Additionally, all members of UIARCA must be notified of such occurrences.

The planning of an agenda for such meetings will be the responsibility of all representatives, and discussion of any issue may also be requested be general members of the organization.

Section 2 - Meetings

1.        The first meeting of each academic year shall be held within the first month of the fall semester classes for the purpose of electing officers and registering the organization by the deadline.

2.         At least (7) days notice of any general meeting, specifying the place, the day and the hour of meeting and the general or special nature of business shall be communicated to the members at large (the non-receipt of such notice by any member shall not invalidate the proceedings with consent of two-thirds of the members.)

3.         A general meeting may be convened on shorter notice than ten (10) days in any manner that such members think fit at any general meeting.

4.         Each Officer shall be responsible for giving a report and addressing questions regarding the relevant delegated areas, during meetings at which this is deemed suitable and at the Executive meetings.

5.          Each regular member shall have one vote.

 

 

Section 3 – Format for Meetings

All meetings shall adhere to the following format

A.         Representatives call the meeting to order

B.         Agenda (including but not limited to)

1. Reading of last meeting minutes

2. Financial report

3. Committee Reports

4. Discussion

a. Old business

b. New business

c. Open floor

C.        Adjournment of the meeting.

 

 

 

ARTICLE V: AMENDMENTS

1. Amendments to this Constitution shall be initiated by the general membership by a two-thirds vote, at a general meeting or by electronic vote.  Voting for such matters shall follow the guidelines outlined under the Voting section of this constitution.

2. An amendment shall become effective immediately following its ratification.

3.  Amendments must be submitted to the Student Organization Recognition Board for approval.

 

ARTICLE VI:  MISCELLANEOUS

Section 1:  Saving Clause

All provisions of any previous by laws of this Association are hereby repealed and any provision of the bylaws or any amendment thereto which is in conflict with the constitution and bylaws of ARCA shall be deemed null and void, but such portions so hold to be null and void shall not effect the validity of the effectiveness of any other portion thereof.

Section 2: Adoption

Immediately following the approval of this constitution it shall be in effect and an election shall be held as nearly as possible in accordance with it.
